Doug Cole represents clients in complex
civil litigation, including intellectual property matters,
at the trial and appellate levels. He has argued five cases
in the U.S. Supreme Court and more than 20 cases in the Ohio
Supreme Court and federal courts of appeals, and has
appeared in state and federal trial courts across the
country. Doug also has a strong technical background, with
degrees in electrical and computer engineering, physics, and
mathematics.
Recent significant representations include a lead role in
briefing an appeal for SanDisk on a patent matter in the
Federal Circuit, briefing and arguing an Ohio Supreme Court
appeal for ProMedica on a statutory interpretation issue,
assisting FirstEnergy on two appeals in the Ohio Supreme
Court, serving as lead counsel for Urban Active in
connection with two consumer class actions in Ohio,
assisting Chrysler with its bankruptcy reorganization at
both the trial and appellate level, petitioning for
certiorari on behalf of Macy's in a state tax matter, and
representing Dell in connection with a major securities
matter. Doug has also done significant amicus work,
including representing a national group of law professors in
a dormant Commerce Clause case at both the Ohio Supreme
Court and the U.S. Supreme Court, and representing a
collection of twenty-four national law firms on an attorney
disqualification issue in the California court of appeal,
which resulted in the first California appeals court
decision expressly recognizing the use of ethical walls as a
means for preventing vicarious disqualification.
Doug has handled patent matters involving various
technologies including telecommunications, semiconductors,
networking, software and growing media. Representative
clients include SanDisk, which he as represented both in the
Federal Circuit and before the ITC, The Scotts Miracle-Gro
Company, Sendmail, and Molycorp.
At the request of Ohio Attorney General Jim Petro, Doug
served as Ohio's state solicitor from 2002-2006. In that
capacity, he argued before the United States Supreme Court
and Ohio Supreme Court on a variety of issues, including the
First Amendment, statutory interpretation, and the dormant
Commerce Clause. Before that, he was a tenure-track
professor at the Ohio State University, teaching courses in
corporations, contracts, and law and economics. Since
joining the Firm, Doug has acted as an adjunct professor at
OSU.
Doug frequently speaks and writes on subjects including
the U.S. Supreme Court, intellectual property trends, and
securities law. Doug is active in the Ohio State Bar
Association, having served on the board of editors for the
Ohio State Bar Journal.
